1. BINDING AGREEMENT

This website is operated by Beyond Lost - The Side Quest Company (Pvt) Ltd .Throughout the site, the terms “we”, “us” and “our” refer to Beyond Lost. By accessing this website and/or purchasing goods from our online store, you (the "User" or "Customer") engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including all additional policies referenced herein.

PLEASE READ CAREFULLY: These Terms constitute a legally binding contract between you and The Side Quest company (Pvt) Ltd (operating as Beyond Lost) in accordance with the Electronic Transactions Act, No. 19 of 2006 and the Consumer Affairs Authority Act, No. 9 of 2003 of Sri Lanka. 2. ONLINE STORE TERMS & ELIGIBILITY

  • Capacity: By agreeing to these Terms, you represent that you are at least the age of majority in Sri Lanka (18 years) or have obtained parental/guardian consent.
  • Lawful Use: You may not use our clothing products or services for any illegal or unauthorized purpose.
  • Security: You must not transmit any viruses, or any code of a destructive nature. A breach of any Term will result in an immediate termination of your Services and potential legal action.

3. PRODUCTS AND SALES (CLOTHING SPECIFIC)

  • Product Representation: We endeavor to display the colors and textures of our apparel as accurately as possible. However, as actual colors depend on your monitor display, we cannot guarantee 100% accuracy.
  • Modifications: Prices for our products are subject to change without notice. We reserve the right to modify or discontinue any garment or collection at any time.
  • Exclusivity: Certain products may be available exclusively online and may have limited quantities. These are subject to return or exchange only according to our Return Policy.
  • Rejection of Orders: In compliance with Sri Lankan commercial law, we reserve the right to refuse any order. We may, at our discretion, limit or cancel quantities purchased per person or per household to prevent unauthorized reselling by "dealers" or "distributors."

4. BILLING AND PAYMENT SECURITY

All content included on this site, such as textile designs, logos, graphics, brand names, and images, is the exclusive property of The Side Quest company (Pvt) Ltd and is protected by the Intellectual Property Act, No. 36 of 2003 of Sri Lanka.

  • You are strictly prohibited from reproducing, duplicating, or exploiting any portion of the Service or the designs sold by Beyond Lost without express written permission from us.

6. LIMITATION OF LIABILITY & DISCLAIMERS

  • "As Is" Basis: To the maximum extent permitted by Sri Lankan law, the service and all products delivered to you are provided 'as is' and 'as available' without any warranties, express or implied.
  • Liability Cap: In no case shall Beyond Lost, our directors, officers, or employees be liable for any injury, loss, or consequential damages arising from your use of the service or any products procured, including but not limited to issues related to fabric or wear-and-tear, beyond the replacement value of the goods.

7. INDEMNIFICATION

You agree to indemnify and hold Beyond Lost and The Side Quest company (Pvt) Ltd harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to your breach of these Terms or your violation of any Sri Lankan law or the rights of a third-party.

8. SEVERABILITY

If any provision of these Terms is determined by a Sri Lankan court of competent jurisdiction to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed without affecting the validity of the remaining provisions.

9. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the Laws of the Democratic Socialist Republic of Sri Lanka.

  • Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.
